I recommend a Gun Trust rather than individual ownership for NFA firearms for the following reasons:

CLEO Sign Off Not Required – The ATF requirement that individuals obtain the signature of the Chief Law Enforcement Officer (Cleo) of the city in which you live, on Form 4, Machine gun/suppressor transfer documents, does not apply to gun trusts. No CLEO signature is required on AT Form 4 transfers to a gun trust. Many Police Chiefs and Sheriffs (Cleos) now refuse to sign. ATF Form 4 transfer forms making acquisition of Class 3 items difficult. The use of a gun trust to acquire class 3 items solves this problem.

No Fingerprint Cards Required – The ATF requirement that an individual supply two sets of fingerprint cards with every Form 4 transfer does not apply to transfers to a gun trust.

No Photographs Required – The ATF requirement that an individual supply two photographs with every Form 4 transfer does not apply to transfers to a gun trust.

Continuity of Ownership – Since a gun trust can last several generations the property in the trust (ie class 3 machine guns, suppressors, short barreled rifles, flamethrowers, etc.) remains in a single entity (gun trust) without the necessity to transfer each item upon the death of a single trustee or beneficiary, where several are named.

Continuity, Breadth and Mutuality of Possession – A properly drafted gun trust can allow various persons to possess and use NFA Class 3 weapons owned by the trust. Several trustees with authority to possess the trust’s NFA Class 3 weapons can be designated. ATF regulations for individuals limit the possession of NFA Class 3 weapons to the registered owner only. Gun trusts can be drafted to allow various persons to use the trust’s NFA weapons over the years without the need to transfer them upon the death or incapacity of a trustee or beneficiary of the trust. Family members or friends can be designated as authorized “users” of trust Class 3 weapons. Nevertheless, when the trust terminates, its property must be distributed to the beneficiaries and a transfer tax paid on each NFA item.

Confidentiality – When a gun trust purchases a Class 3 weapon, it must submit a copy of the trust to the ATF with the Form 4. The NFA gun trust is otherwise confidential. It is not filed of record and, other than NFA weapons purchased by the trust which must be registered with the ATF, its assets are confidential and need not be disclosed.
If you enjoy shooting machine guns, using silencers or other class 3 firearms or you are looking to own one, do not be discouraged by red tape or government resistance to deny you of your legal rights. I create a legal entity called a Gun Trust that overcome the hassles, limitations, and out right denial of individual class 3 ownership.

The Cybersecurity Act

On Thursday, July 26, 2012, the Senate passed an 84-11 vote to move the Cybersecruity Act forward. The Act is to help prevent cyber terrorism on America’s infrastructure such as water departments and our power grids. The Cybersecruity Act would make critical private industries meet security standards set down by the Department of Homeland Security. Soon after approval to move forward, so was the approval to allow the addition of amendments to the bill.

Along with Lautenberg, Barbara Boxer from California, Jack Reed from Rhode Island, Bob Menendez from New Jersey, Kirsten Gillibrand from New York, Chuck Schumer from New York, and Dianne Feinstein from California introduced S.A. 2575, a large capacity magazine ban, to the House of Representatives to be added to the Cybersecurity Act of 2012. The wording of the amendment does not define what high capacity means.

S.A. 2575 states, “Except as provided in clause (ii), it shall be unlawful for a person to transfer or possess a large capacity ammunition feeding device. Clause (i) shall not apply to the possession of a large capacity ammunition feeding device otherwise lawfully possessed within the United States on or before the date of the enactment of this subsection. “

The vote to include S.A. 2575 on the Cybersecurity Act or not is expected next week. If S.A. 2575 gets included in the Cybersecurity Act, and the Cybersecurity Act passes, it will be illegal to produce new high capacity magazines. The White House has supported the Cybersecurity Act, stating, “The Administration strongly supports Senate passage of S. 3414, the Cybersecurity Act of 2012.”

The Stop Online Ammunition Sales Act

Representative Carolyn McCarthy of New York has joined Lautenberg in introducing the Stop Online Ammunition Sales Act, which would prevent online sales of ammunition and force dealers to report large sales of ammunition to local police. Lautenberg says, “If someone wants to purchase deadly ammunition, they should have to come face-to-face with the seller.” The Stop Online Ammunition Sales Act would also restrict individual ammunition sales, requiring ammunition be purchased only through licensed dealers, force buyers to present photo ID at the time of purchase, ban online and mail order sales of ammunition, require dealers to keep records of all sales of ammunition, and require dealers to report people who buy more than 1,000 rounds of ammunition in five days.

Citing the massacre in Colorado and the “less publicized acts of violence” that plague the nation’s cities, the president told the National Urban League that steps to reduce gun violence “should not be controversial, they should be common sense.”

Following an “extraordinary heartbreaking tragedy” like the deadly shooting in Aurora, Colo., Obama said there is “always an outcry immediately after for action,” but that “too often those efforts are defeated by politics and by lobbying and eventually by the pull of our collective attention elsewhere.”

“Steps to reduce violence have been met with opposition in Congress. This has been true for some time, particularly when it touches on the issue of guns,” he said.

The president made clear his support for Second Amendment rights, saying “hunting and shooting are part of a cherished national heritage.”

“I also believe a lot of gun owners would agree that AK-47s belong in the hands of soldiers, not in the hands of criminals. That they belong on the battlefield of war, not on the streets of our cities,” he said.

Going forward, Obama vowed to work with members of both parties to “arrive at a consensus around violence reduction, not just of gun violence, but violence at every level.”

A heavily armed gunman attacked an Aurora, Colorado, movie theater early Friday, tossing tear gas before opening fire on the terrified audience and killing 12 and wounding 38, authorities said. The theater was showing the new Batman movie, “The Dark Knight Rises.”

Witness recalls chaos after gunman bursts into theater

One of the injured was just 3 months old, according to hospital workers.

Police arrested a man believed to be the shooter in a rear parking lot of the theater, Frank Fania, a police spokesman, told CNN.

“He did not resist. He did not put up a fight,” Fania said. Police seized a rifle and a handgun from the suspect, and another gun was found in the theater, he said.

Two federal law enforcement sources involved in the investigation identified the suspect as James Holmes, 24, of Aurora, Colorado.

Aurora Police Chief Dan Oates said there was no evidence of a second gunman, and FBI spokesman Jason Pack said it did not appear the incident was related to terrorism.

President Barack Obama said he and first lady Michelle Obama were “shocked and saddened” by the shooting and pledged the administration’s support for victims of the shooting.

“As we do when confronted by moments of darkness and challenge, we must now come together as one American family,” Obama said.

Chaos broke out during the showing of “The Dark Knight Rises” at the Century Aurora 16 theater when the shooting began, police and witnesses said.

Police said the gunman appeared in the front of the theater and threw a smoke bomb before opening fire. A federal law enforcement official told CNN the smoke bomb described by witnesses was tear gas.

It was unclear how the man got into the theater, but witnesses told CNN affiliate KUSA that he came in through an emergency door.

One movie-goer, who was not identified, told KUSA the gunman was wearing a gas mask.

Some people in the audience thought the thick smoke and gunfire was a special effect accompanying the movie, police and witnesses said.

The smoke smelled like a Fourth of July firework, said CNN iReporter Adam Witt. It took a few gunshots before he figured out what was going on.

“There were so many people running,” he said. “I didn’t look back. I just remember getting up from the floor and shouting, ‘We have to run.’”

Witt said he held his wife’s hand as they rushed out of the theater.

“There was a moment where I lost her hand, but I grabbed her shirt,” he said. “We didn’t let go of each other.”

Quentin Caldwell, who was attending a screening in the adjacent theater, said he wasn’t sure at first what was going on, despite hearing a “pop, pop, pop, pop” sound.

“We really didn’t know something was happening until someone came from the left entrance and said we should not go outside because somebody with a gun was out there,” he said.

Armed guards appeared at the theater exit and demanded audience members raise their arms to ensure they were not carrying weapons, then told them to run, Caldwell said.

“Outside was chaos. There was wounded everywhere,” he said.

Cell phone video taken by someone at the theater showed scores of people screaming and fleeing the building. Some had blood on their clothes.

One police officer carried a girl believed to be about 9 with gunshot wounds to her back out of the theater, a witness said. “She wasn’t moving.”

Witness: ‘We have to run’

Officers rushed many of the wounded to hospitals in their patrol cars.

Authorities also have evacuated the suspect’s Aurora apartment building after he made a statement about explosives in his unit, Oates said.

The shooter used at least four guns — an “AK type” rifle, a shotgun and two handguns, a federal law enforcement official told CNN. The source also said the shooter used tear gas.

Bureau of Alcohol, Tobacco and Firearms agents have searched the suspect’s car and went to his home to search for explosives, agency spokesman Tom Mangan said.

Law enforcement officers who searched the suspect’s apartment found “items of interest,” a federal law enforcement source involved in the investigation told HLN. He did not elaborate.

A woman who lives across the street from where the suspect is believed to live said her building was evacuated by police around 4 a.m.

“They told us there was a bomb or bomb material located in the house across the street from us.” Rebecca Bradshaw said.

In addition to looking into the possibility of explosives, ATF agents also are conducting emergency traces on the weapons used to see how they were obtained, Mangan said.

KWGN: Witnesses first thought gunfire was part of movie

Police initially said 14 people had died — 10 in the theater and four at area hospitals, but revised the death toll to 12 later Friday morning, according to Aurora Police Lt. Jad Lanigan.

Several people remained in critical condition at area hospitals.

Of the wounded, at least 20 were being treated at the University of Colorado Hospital, said spokeswoman Jacque Montgomery. All of the wounded suffered from gunshot wounds, which ranged from minor to critical, she said.

“They’re arriving by police, by ambulance. Some are walking in,” she said.

The victims being treated there ranged in age from 3 months to 45, the hospital said.

Denver Health Center had six patients from the shooting, one in critical condition and five in fair condition, said Shelly Davis, house supervisor.

Swedish Health Center spokeswoman Nicole Williams said her hospital was treating three people, two of them in critical condition and one in fair condition. A fourth patient was on the way, she said.

Parker Adventist Hospital was treating two people for minor injuries, according to a spokeswoman.

Hundreds of police officers descended on the theater, and the FBI has joined the investigation.

“We were calling for help from every police and fire agency,” Fania said.

Warner Bros., the studio behind the movie, said the company and filmmakers were “deeply saddened” to learn of the incident. The studio canceled the movie’s Paris premiere, while New York police Commissioner Raymond Kelly said his officers would watch over screenings of “The Dark Knight” to prevent copycat shootings.

Aurora, a Denver suburb, is about 13 miles from Littleton, Colorado — site of the April 1999 Columbine High School massacre.

In that incident, two teenage students, Dylan Klebold and Eric Harris, armed themselves with guns and bombs and opened fire inside the high school. They killed 13 people and wounded 23 others before killing themselves.

An elderly man foiled an armed robbery attempt in Florida by pulling out his own gun and shooting the would-be bandits.

A surveillance camera caught 71-year-old Samuel Williams jump out of his seat and head toward the two armed men.

The men were trying to rob an Internet cafe in Ocala.

One suspect was shot in the arm — the other one in the buttocks and right hip.

Both 19-year-olds were later arrested and taken to a hospital. The men have been charged with armed robbery.

Williams has a license to carry a concealed weapon and does not face any charges.

Recent reports of violence in Lubbock have led to an increase in local gun sales. So how safe is the Hub City?

The perception is the city is unsafe. So we asked the Lubbock Police Department for the crime statistics of burglaries over the past three years. On average, there are nearly 200 a month. The number seems alarming, but the statistics show burglaries are down.

In April there were 224 break-ins. That month last year there were 240. March of this year there were 176. That’s compared to 204 in March of 2011.

However, the latest home invasions and shootings are causing concern.  Just one week ago we heard the terrifying story of a woman hiding under her bed, while a gunman beat her brother.

“I figured they would find me under the bed and shoot me,” Terry Losoya said as tears rolled down her face.

While she is recovering, others are finding comfort in their hands behind the trigger.

Sharp Shooters sales representative, Matthew Barnes, says they have received dozens of calls. Some people are mentioning the string of violent activity.

“We had a gentleman call this morning saying the home invasions were scaring him and his wife,” Barnes said.

Because of the increased demand and election season, Barnes says, some guns are hard to come by.

“We have one particular handgun where we have 25 people waiting to get,” he said.

Sgt. Jonathan Stewart says using a gun in your home is legal under Texas law, as long as you’re not a felon. If you want to carry it concealed, you will need a CHL (Concealed Handgun License).

“A person is allowed to use deadly force to defend themselves against someone who is trying to use deadly force against them,” said Stewart.

However, police advise using that force could have ramifications.

“There may be some liability if someone else is recklessly hit by a bullet or something along those lines,” said Stewart.

As for burglaries, Stewart says, that type of crime is not usually random.

“There is normally some previous contact or previous happening that can lead up to these types of things,” he said.

Police advise if you are being burglarized to always give up your possessions. They say no property is worth losing a life.

A message posted on the McMillan Group Facebook page from Kelly D. McMillan, Director of Operations, this past Thursday shed light on how everything went down.

Today Mr. Ray Fox, Senior Vice President, Market Manager, Business Banking, Global Commercial Banking came to my office. He scheduled the meeting as an “account analysis” meeting in order to evaluate the two lines of credit we have with them. He spent 5 minutes talking about how McMillan has changed in the last 5 years and have become more of a firearms manufacturer than a supplier of accessories.

At this point I interrupted him and asked “Can I possible save you some time so that you don’t waste your breath? What you are going to tell me is that because we are in the firearms manufacturing business you no longer what my business.”

“That is correct” he says.

I replied “That is okay, we will move our accounts as soon as possible. We can find a 2nd Amendment friendly bank that will be glad to have our business. You won’t mind if I tell the NRA, SCI and everyone one I know that B of A is not firearms industry friendly?”

“You have to do what you must” he said.

“So you are telling me this is a politically motivated decision, is that right?”

Mr. Fox confirmed that it was. At which point I told him that the meeting was over and there was nothing let for him to say.

I think it is import for all Americans who believe in and support our 2nd amendment right to keep and bear arms should know when a business does not support these rights. What you do with that knowledge is up to you. When I don’t agree with a business’ political position I can not in good conscience support them. We will soon no longer be accepting Bank of America credit cards as payment for our products.
